The Importance of a Joint Sponsor in the Financial Affidavit of Support (Form I-864) is often overlooked. When applying for a green card through family sponsorship, one of the essential steps is completing the Affidavit of Support (Form I-864). This form acts as a binding contract between the U.S. government and the sponsor, ensuring that the immigrant will not become a public charge. However, many of our clients face a common challenge, their primary sponsor does not meet the income requirements set by the government.

Why You Might Need a Joint Sponsor?

To qualify as a sponsor, the primary sponsor must demonstrate an income level of at least 125% above the Federal Poverty Guidelines. Unfortunately, not everyone meets this threshold. That’s where the joint sponsor comes in. A joint sponsor is someone who agrees to share the financial responsibilities, ensuring that the immigrant can successfully complete the green card process.

Many of our clients need to find a joint sponsor to fulfill these financial requirements. Securing a joint sponsor is often the key to moving forward with the green card application.

The Role and Responsibilities of a Joint Sponsor

If you’re considering becoming a joint sponsor, it’s important to understand the commitment you’re making. By signing Form I-864 as a joint sponsor, you are legally agreeing to provide financial support to the immigrant if their income falls below 125% of the Federal Poverty Guidelines. This obligation remains in place until the immigrant becomes a U.S. citizen, earns 40 quarters of work (approximately 10 years), leaves the U.S. permanently, or passes away.

What Are the Risks?

While it’s true that signing Form I-864 is a serious legal obligation, it’s important to note that in reality, it is extremely rare for the government to sue a joint sponsor to collect money. The primary purpose of this agreement is to ensure that the immigrant cannot apply for public benefits such as food stamps or welfare, rather than to hold the joint sponsor financially responsible. This provides some peace of mind to those considering taking on this role.

 A Life-Changing Gift

Becoming a joint sponsor is more than just a financial commitment; it’s an opportunity to change someone’s life. The ability to help someone secure a green card is a profound gift, one that can provide stability, opportunity, and a brighter future for the immigrant and their family. It’s a role that carries significant responsibilities, but the rewards of knowing you’ve helped someone achieve their dreams of living in the United States are immeasurable.
